Acceptance of Terms
By downloading, accessing, or using Gymex Fitness (also known as "Locked In"), you agree to these Terms of Service. If you do not agree, do not use the app.
Eligibility & Accounts
- You must be at least 13 years of age to use Gymex.
- You must provide accurate account information and keep it up to date.
- You may create an account using email and password or Apple Sign-In.
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activity that occurs under your account.
- You may not create multiple accounts to circumvent bans or restrictions.
Health & Fitness Disclaimer
Gymex Fitness provides tracking and informational tools only and is not medical advice. This includes all workout tracking, nutrition logging, body metrics, progress photos, and related features. Consult a qualified healthcare professional before starting or changing any fitness or nutrition routine.
You are solely responsible for your own health and safety when following any workout program, nutrition plan, or fitness recommendation provided through the app.
AI Features Disclaimer
Gymex includes AI-powered features such as the AI Coach, AI Program Builder, AI-generated workouts, smart weight recommendations, auto periodization, plateau detection, overtraining alerts, post-workout analysis, and weekly AI recaps. These features are powered by third-party AI services (DeepSeek) and are provided for informational and convenience purposes only.
- AI coaching is not a substitute for a certified personal trainer, nutritionist, or medical professional.
- AI recommendations are generated algorithmically and may not be appropriate for your individual circumstances, injuries, or medical conditions.
- You should use your own judgement when following any AI-generated workout, nutrition suggestion, or training recommendation.
- We are not responsible for any injury, health issue, or adverse outcome resulting from following AI-generated recommendations.
- AI features require an active paid subscription and use of these features constitutes consent to the data processing described in our Privacy Policy.
Subscriptions & Billing
Gymex offers three paid subscription tiers (Core, Premium, and Pro Premium) as auto-renewable subscriptions managed through RevenueCat. Billing, renewals, and cancellations are handled by the platform provider (Apple App Store or Google Play) under their terms.
- Core: AI Speech-to-Text, AI Generated Workouts, AI Auto Weight Intelligence, and AI RIR Logger.
- Premium: Everything in Core, plus AI Custom Voice, AI Macro Tracking, Agent Interactive Chat, Smart Calorie Notifications, and Hydration Reminders.
- Pro Premium: Everything in Premium, plus AI Auto Periodization, AI Workout Summary Chat, Plateau Detection, Overtraining Alerts, and Post-Workout Analysis.
Free users retain access to all non-AI features including workout tracking, nutrition logging, body metrics, progress photos, community features, messaging, and program building.
We reserve the right to modify subscription pricing and features. Changes to pricing will not affect your current billing period.
Voice Data & AI Processing
When you use voice-based features (AI Voice Logger, custom AI voice), your voice recordings are sent to ElevenLabs for speech-to-text processing. By using these features, you consent to this processing.
When you use the AI Coach or other AI-powered features, relevant personal data (including workout history, body metrics, nutrition data, and profile information) is sent to DeepSeek for processing. This data is transmitted securely and is not stored by DeepSeek beyond the duration of the request. Full details are available in our Privacy Policy.
Acceptable Use
- Do not misuse the app, reverse engineer it, or attempt unauthorised access to any systems or data.
- Do not post harmful, abusive, hateful, sexually explicit, or unlawful content in community features, direct messages, or your profile.
- Do not use the service in a way that disrupts other users or system integrity.
- Do not attempt to manipulate, exploit, or abuse AI features (including prompt injection or attempting to bypass safety filters).
- Do not use the referral or creator program in a fraudulent or deceptive manner.
- Do not share or distribute the content of other users' private data, workouts, or messages without their consent.
Content & Community
You retain ownership of content you post. By posting in app community features (including the community feed, comments, and shared workouts), you grant us a limited license to host, display, and process that content in order to operate the service.
Programs you share via share links are accessible to anyone with the link. Shared programs include the program structure only (exercises, sets, reps, rest periods) and do not include your personal performance data.
Direct messages between users are private and are not shared publicly. However, we reserve the right to review messages when investigating reports of abuse, harassment, or violations of these terms.
Progress Photos & Body Data
Progress photos you upload are stored securely and are private to your account by default. Body metrics (weight, height, measurements) are also private unless you explicitly share them. You can delete your progress photos and body metrics at any time from within the app.
Do not upload progress photos or profile images that contain inappropriate, explicit, or illegal content. Violations may result in content removal and account action.
Device Integrations
Gymex supports pairing with third-party fitness devices (such as Garmin watches). By pairing a device, you consent to the exchange of fitness data between your device and the app. You can unpair your device at any time from Settings. We are not responsible for the accuracy or reliability of data received from third-party devices.
Moderation & Enforcement
We reserve the right to moderate all user-generated content and enforce these terms to maintain a safe and respectful community. Moderation actions may include, but are not limited to:
- Removing or hiding content that violates these terms or community standards.
- Issuing warnings to users who engage in prohibited behaviour.
- Temporarily suspending a user's ability to post in community features (community bans).
- Permanently revoking access to community features.
- Resetting a user's profile picture or display name if they contain inappropriate content.
- Suspending or permanently banning a user's entire account in cases of serious or repeated violations.
- Applying device-level bans to prevent circumvention of account bans.
Moderation decisions are made at our sole discretion. All enforcement actions are logged internally for accountability and transparency.
Termination
We may suspend or terminate your access to part or all of the service if you violate these terms, engage in behaviour that threatens the safety or wellbeing of other users, or if required for legal compliance. Grounds for termination include, but are not limited to:
- Posting abusive, harmful, hateful, or unlawful content.
- Harassment, bullying, or threatening behaviour toward other users.
- Spamming, impersonation, or fraudulent activity.
- Attempting to exploit, reverse engineer, or interfere with the app or its systems.
- Abuse or manipulation of AI features.
- Uploading inappropriate progress photos or profile images.
- Repeated violations of community guidelines after prior warnings.
- Creating multiple accounts to evade bans or restrictions.
- Any other conduct we reasonably determine to be harmful to the service or its users.
Where possible, we will notify you of the reason for suspension or termination. However, we reserve the right to act immediately and without prior notice in cases involving serious threats to user safety or platform integrity.
Appeals & Refunds
If your account has been suspended or terminated, you have the right to appeal the decision by contacting us at gymex374@gmail.com. We will review all appeals fairly and respond within a reasonable timeframe.
If you hold an active paid subscription at the time your account is banned or terminated, you are entitled to a refund for the remaining unused portion of your current billing period. For example, if you have paid for a monthly subscription and your account is banned partway through that month, you will receive a refund for the time you are unable to use the service. Refunds do not apply to previous billing periods that were fully used.
Refund requests related to account termination should be directed to gymex374@gmail.com. Please note that subscription billing is managed through RevenueCat and the relevant app store, so some refunds may need to be processed through Apple App Store or Google Play.
Limitation of Liability
To the maximum extent permitted by law, the service is provided "as is" without warranties, and we are not liable for indirect, incidental, or consequential damages arising from use of the app. This includes, but is not limited to, any injury, health issue, or adverse outcome resulting from following AI-generated recommendations, workout programs, or nutrition suggestions provided through the app.
Changes to Terms
We reserve the right to update or modify these Terms of Service and our Privacy Policy at any time, at our sole discretion. Changes will take effect when posted within the app or on our website. We will make reasonable efforts to notify you of significant changes, but it is your responsibility to review these terms periodically. Your continued use of the app after any changes are posted constitutes your acceptance of the revised terms.
